1.2 Information Collected Automatically

When you interact with Silky Fanz, we automatically collect certain technical and behavioral data:

  • Technical Log Data: IP address, browser type and version, operating system, device type, device hashes, screen resolution, and language settings.

  • Geolocation Data: Approximate geographic location derived from IP addresses. Precise GPS location is not collected unless required for regulatory/legal compliance or explicitly authorized by you.

  • Usage and Interaction Data: Time stamps, pages visited, duration of visits, referral URLs, links clicked, search queries within the Platform, and interaction with other users or content (e.g., subscriptions, tips, likes).

1.3 Information From Third-Party Partners

We may receive information about you from:

  • Identity Verification Vendors: Third-party compliance providers who verify the authenticity of your government ID, validate your age, and perform AML (Anti-Money Laundering) or KYC (Know Your Customer) screenings.

  • Tax Compliance: To collect, verify, and file tax documents (e.g., 1099-NEC, W-9, W-8BEN) with appropriate taxing authorities.

  • Legal Inquiries: To cooperate with valid law enforcement requests, court orders, subpoenas, and to prevent, detect, and mitigate Child Sexual Abuse Material (CSAM), non-consensual content (revenge porn), or human trafficking.

3. THIRD-PARTY SHARING AND DATA TRANSFERS

Silky Fanz does not sell, lease, rent, or share your personal information to third parties for monetary consideration or cross-context behavioral advertising.

We only disclose your information to the following categories of trusted third parties in order to operate our Platform and comply with the law:

  1. Identity & Age Verification Service Providers: Third-party automated verification platforms that analyze government-issued identification cards and utilize biometric facial recognition to confirm your identity and legal age.

  2. Payment Processing & Financial Institutions: PCI-DSS compliant payment gateways and acquiring banks to process credit/debit card transactions, and secure payout providers to route funds to Creators.

  3. Cloud Infrastructure & Hosting Providers: Industry-standard secure hosting, content delivery networks (CDNs), and database storage providers.

  4. Professional Advisors: Legal counsel, auditors, and tax professionals who assist in compliance, corporate governance, and litigation.

  5. Law Enforcement, Regulatory, and Judicial Authorities: We will disclose user data if required to do so by law, or in the good faith belief that such action is necessary to:

    • Comply with a legal obligation, subpoena, or court order.

    • Protect and defend the rights or property of Silky Fanz.

    • Act in urgent circumstances to protect the personal safety of users, creators, or the public.

    • Report suspected violations involving CSAM or non-consensual sexual content directly to the National Center for Missing & Exploited Children (NCMEC) or relevant law enforcement bodies.

International Data Transfers

Our servers are located in the United States. If you reside in the European Union (EU), United Kingdom (UK), Canada, or other jurisdictions with strict data transfer regulations, please note that your personal data will be transferred to, stored, and processed in the United States. We implement appropriate safeguards (such as Standard Contractual Clauses approved by the European Commission) to ensure your data receives an equivalent level of protection.

4. AGE VERIFICATION, MINOR PROTECTION, AND RECORD-KEEPING

Due to the nature of our platform, we maintain an absolute zero-tolerance policy for underage access, exploitation, and illegal content.

4.1 Biometric & Identity Verification Disclosure

To prevent underage registrations and satisfy identity verification mandates:

  • Creators must submit a government-issued photo ID and a real-time facial photo (selfie).

  • We utilize external specialized verification partners to analyze these images. Our partners may extract biometric indicators (facial geometry templates) to verify that the photo on the ID matches the selfie.

  • Biometric templates are processed solely for authentication and fraud prevention. Silky Fanz does not store biometric templates on its own servers. Any biometric data generated by our verification partners is retained only for the duration of the verification transaction and is securely destroyed immediately thereafter, or within a maximum of thirty (30) days, unless a longer retention period is mandated by law or court order.

4.2 18 U.S.C. § 2257 Compliance Record-Keeping

Under United States federal law (18 U.S.C. § 2257), we are required to maintain highly detailed records for all Creators who upload sexually explicit content. This includes:

  • The Creator's legal name, any stage names or professional aliases, and date of birth.

  • A photocopy of a valid, government-issued identification document.

  • Documentation linking the verified identity to specific content uploaded.

  • Retention Period: These compliance records must be maintained by the Platform for a minimum of five (5) years from the date the content is produced or hosted on our servers, or as otherwise required by federal law, and are subject to inspection by the Department of Justice.

5. DATA SECURITY AND RETENTION

5.1 Technical and Administrative Safeguards

We implement robust administrative, technical, and physical security measures designed to protect your personal data from unauthorized access, loss, misuse, alteration, or destruction:

  • All financial transactions and data transmissions are encrypted using Secure Socket Layer (SSL) / Transport Layer Security (TLS) protocols.

  • Database encryption is utilized for sensitive storage.

  • Access to sensitive personal data (such as identification documents and financial details) is strictly restricted to authorized employees on a "need-to-know" basis.
